1. Acceptance of these terms

These Terms of Use ("Terms") govern your access to and use of the Sarth legal application and the website at sarthlegal.com (together, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Who provides Sarth

The Service is developed by Sun Integrated Technologies Pvt. Ltd. (SITA), the technology development arm of the MGRM Group, under the digital initiative of MGRM Digital Cloud Services Pvt. Ltd. (MDCS), and is hosted and managed on the SooLegal platform.

3. Eligibility and accounts

You must be at least 18 years old and capable of entering into a binding contract to use the Service. You are responsible for the accuracy of the information you provide, for keeping your account credentials secure, and for all activity under your account.

4. The Service

Sarth lets you search and track court case status across the Supreme Court, High Courts, District Courts, and various tribunals; search judgments; access bare acts; set hearing reminders; and use related features. Sarth aggregates information from official court databases and the National Judicial Data Grid and other public sources.

5. Accuracy and availability of information

Sarth strives to present information that is accurate and current, but the underlying data is sourced from third-party and government systems that may be incomplete, delayed, or unavailable. Sarth does not warrant that any information is accurate, complete, or up to date, and is not liable for decisions taken in reliance on it. Always confirm important information — such as hearing dates and orders — against official court records.

6. Free and premium plans

Sarth offers a free plan with basic features and a premium subscription with additional features. Details, inclusions, and pricing of premium plans are described in the app and on the Download page and may change. Subscription fees, billing cycles, renewals, and cancellations are governed by the plan terms presented at the time of purchase. Payments are processed by third-party payment providers.

7. Find My Case service

The "Find My Case" research service is offered on a "No Find, No Fee" basis as described on the Find My Case page. You pay only if the case or record is found and delivered in line with the stated criteria. The definitions of "found" and "not found", turnaround, and fee terms are those set out on that page and communicated to you when you submit a request.

8. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or court rule.
  • Scrape, harvest, or bulk-extract data, or place unreasonable load on the Service.
  • Attempt to gain unauthorised access to the Service, other accounts, or connected systems.
  • Misuse personal information obtained through the Service, or use it to harass or harm any person.
  • Reproduce, resell, or commercially exploit the Service or its content without our written permission.

9. Intellectual property

The Service, including its software, design, branding, and original content, is owned by Sun Integrated Technologies Pvt. Ltd. and its affiliates and is protected by applicable laws. Court judgments, statutes, and public records are not owned by Sarth. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

10. Third-party links and services

The Service may reference or link to third-party sites and services (such as eCourts, payment providers, and app stores). We are not responsible for the content, policies, or practices of those third parties.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. Nothing in the Service constitutes legal advice or an advocate-client relationship.

12. Limitation of liability

To the maximum extent permitted by law, Sarth and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from your use of or inability to use the Service or reliance on any information provided.

13. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or use the Service in a way that may cause harm or legal liability. You may stop using the Service at any time.

14. Governing law and disputes

These Terms are governed by the laws of India. Subject to applicable law, the courts at [jurisdiction to be confirmed] shall have exclusive jurisdiction over any disputes arising from these Terms or the Service.

15. Changes to these terms

We may update these Terms from time to time. Material changes will be notified through the app or website, and the "Last updated" date above will be revised. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
